Terms Of Service

By commissioning me, you agree to these terms of service.

General Terms

♡ Please be patient when working with me.
♡ Don't be afraid to ask for help if you don't have a clear idea for your commission already, I will try to help the best I can!
♡ I reserve the right to alter my terms of service and prices at any time. (New rules will not affect any orders made based on previous rules).
♡ I will do most revisions for free during the early stages of art. I may ask for an extra fee for larger revisions, especially during later stages of the artwork.
♡ I reserve the right to decline any commission.
♡ I retain all artistic copyrights to post/use commissioned artworks unless otherwise discussed. (Terms vary for commercial-use.)
♡ Credit must be given to me, JustAen, when commissioned artwork is posted or used. This credit MUST be clearly available for the public to find

Payment Terms

♡ Please be aware that prices may change depending on complexity.
♡ Commercial use will incur an additional fee.
♡ Payments are made through PAYPAL.
♡ Payment must be made in full before I finish the commission. I will usually ask for payment once the sketch is finalized.
♡ There are NO refunds. The only time I will issue a refund is if I'm unable to complete the commission for some reason.
♡ All Prices are in USD

Art Process

♡ Discussion
Details, references, poses, and styles will be discussed along with pricing, due dates, and other information regarding the commission. (I may stream working on commission on my Twitch. Please mention ahead of time if you are not okay with this.)
♡ Sketches
A rough sketch of the design is provided in the requested style. This is the best time to make any changes on larger details like posing or outfits. Once this is finished, I need the FULL payment.
I may then provide a tidied sketch.
This is a cleaner, that may include a little bit of shading as a test. This is the closest preview to the final piece and is the best time to ask for specifics on things being changed.
♡ Major Changes Beyond this point will incur an extra fee!!
Things such as color changes or small anatomy/shading changes can be discussed but style changes or major anatomy changes (anything that would require pieces to be completely reworked/redrawn) will cost extra!
♡ Rendering
Shading and highlighting. I will send several updates at this point to make sure you like how it’s looking.
♡ Finished Product
I will send you the final unwatermarked PNG files via google drive or a zip file.

COPYRIGHT / USAGE POLICY

♡ The commissioner may repost and use the commissioned piece, but you MAY NOT make any edits to the artwork without prior permission from myself, JustAen. Credit MUST be given.
♡ The commissioner is allowed to use the commissioned artwork for personal use ONLY unless agreed otherwise.
♡ If the client requests characters of IPs not belonging to them (e.g. fanart of existing characters), they are solely responsible for the use of commissioned work. The artist holds no responsibility for DMCA claims due to the use of copyrighted characters.
♡ The commissioner is allowed to use the art to promote themselves with proper credit given to JustAen.
THE FOLLOWING IS CONSIDERED COPYRIGHT INFRINGEMENT
✖ Reproducing/using the copyrighted artwork commercially. [Unless stated and agreed upon with the commissioner]
✖ Taking Credit for the creation of the artwork.
✖ Removing any watermarks/signatures.
✖ Altering the artwork without my consent.

Before starting a project, we need to make sure we are on the same page so there aren't any misunderstandings, so please take some time to read through these terms! Thank you!Terms of Service AgreementThis agreement is between I, the Artist, and you, the Client, for work services performed on a project known as the Work.ContentI, the Artist, have the right to refuse projects and requests according to my discernment and capabilities. Some content that I will not be comfortable with representing include but may not be limited to:- Explicit pornographic NSFW
- Underage NSFW of ANY KIND
- Non Canonical Ageing up for NSFW purposes
- Excessively muscular form
- Extreme gore or excessive violence
- Any discriminatory, hateful, offensive, or political artIf you are unsure on something, please ask.I, the Artist, warrant that the Work will be my original work performed to the best of my ability.Artistic style is subject to minor changes as I improve and develop as an artist. I have the right to use existing commercial licensed or commercial free construction assets such as brushes, vectors, symbols, patterns. templates, and more, and educational material such as anatomy, pose reference, tutorials and so on.Timeline & ProcessThe completion of the Work requires 1 day at minimum, and may typically average 3 days to 1 week, depending on commission type, complexity, and workload of commissions. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes. Note that each project may vary. Please be patient with the artist. Please plan accordingly and communicate with the artist.Most revisions of the artwork will be free during the early stages of art. Revisions later in the process such as after line art may incur an extra fee unless they are minor changes. I will actively reach out for feedback. Additional charges may be required for major revisions that may impact the progress and timeline of the project.Delivery of finished work will be through Google Drive, Email, or Zip files sent through discord. This can be changed based on preference but will generally be done through one of these ways.CommunicationCommunication will take place throughout the entire project timeline with updates and bouncing ideas. I will typically ask for feedback when I have something to show. I will let you know if anything is causing delays or priority shifts in the project.I will primarily use Discord direct messaging to facilitate communications. I will typically respond quickly, but any length of time taken without an update is usually in order to provide a better, more concrete, update.Clients agree to provide all required references, information and assets before work starts, or during the process as soon as possible.Clients agree to remain respectful and agree that communication channels I provide should remain relatively professional.Rights, Usage & CreditsArtist RightsI retain original copyright and ownership of the Work, which includes but may not be limited to redistributing, reproducing, advertising, displaying the work on my websites, social media, and portfolios according to my discretion. I have rights to repurpose unused process work for future projects, personal or otherwise.The process will likely be posted on Twitter and Instagram and/or streamed on Twitch or Youtube unless Clients request otherwise before the project begins. An NDA or confidential commission status may be subject to a small fee.Client RightsClients are granted exclusive rights for personal use of the work produced as agreed upon, which must not be transferred to any other parties. Personal use may include but is not limited to:- Social media profile pictures
- Overlays
- Banners
- Wallpapers
- Social media posts
- Physical prints and products
- Character artClients may not at any time modify, edit, change the work without permission from the Artist.Clients may not claim work as their own or anyone else’s and therefore must credit me as the Artist using my social tag/username/link @JustAen.Commercial RightsUnless specified in the commission information or otherwise discussed and agreed upon, commercial licences and reselling rights are not included. Commercial means usage on any monetized work, including but not exclusive to:
- Merchandise
- Monetized videos
- Music releases
- Reselling rights (Selling the work to another party or another platform or on any platform.)Any Work done or made available to the client must not be used for AI (Artificial Intelligence, Machine Learning, AI/ML Training, NFT, blockchain or any for profit platforms or purposes.) Such usage is completely prohibited and may result in legal action taken.Commercial licences may require additional charges of minimum 100%, but are priced on a case-by-case basis. Please ask for more information.Payments, Cancellation, RefundsPaymentBefore starting the project, the Client may be required to pay a 50% upfront payment with the remaining 50% due at the final complete sketch before the final artwork can begin. Other times the Client may pay in full at the final complete sketch. This is on a case by case basis.Invoices or a payment link will be sent when work is ready to begin or once the sketch is finished before the final project is begun.When invoice or payment link is received, the Client agrees to pay within a reasonable timeframe (within 2-3 days) unless circumstances are communicated otherwise in advance, or the project/waitlist position may be cancelled by the Artist.Prices are in USD, and paid via Paypal or other methods as provided by the Artist. Prices may change depending on the complexity of the commission.By engaging on any project, once work has started, or transactions have been made through Paypal or any payment service provider, the Client acknowledges the product and deliverables are DIGITAL and there are no physically shipped goods to receive. Chargebacks are not permitted and the refund policy as mentioned will be followed.Cancellation & RefundIf Client requests cancellation, refunds may not be possible depending on the amount of time spent on the artwork. Once Work begins, refunds are generally not possible unless initiated by the Artist.If for any unforeseen reason I cannot complete the Work or the Work is significantly delayed, I will take initiative to inform you and provide a partial refund if work done up to this point is accepted, or a full refund.Business ClientsFor businesses, agencies, organisations, management, and groups, please contact me to arrange in more detail.AgreementI reserve the right to refuse to accept projects for any reason.By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed above.The date for this agreement is upon the first inquiry/communication for the commission or upon the first transaction made.

♡ PNGTuber Models are priced based on the initial style + $5 - $10+ for each expression. Different poses will incur an additional fee.
♡ Character sheets are priced based on the initial style, how many poses or outfits you want, complexity of character designs, etc etc.
